Excessive Speeding Ticket I just got my first excessive speeding ticket. I'm 24 and have only had two minimum tickets. One 70 in a 50, and one 115 in an 80 that I got a break on. Those were both over two years ago. I was apparently doing 122 in an 80. It was stupid, I know. Do I have a chance at getting this reduced? I don't think I deserve to have the "criminal offence" and the driver risk premium, given my previous record. Can I at least get it reduced so I don't get the driver risk premium? I don't mind the fine so much as the bad record. I've never disputed a ticket before. Help please. |
If I can't get the points reduced, and there is a minimum fine for the excessive speeding and they can't reduce that either, how do I dispute it? I don't dispute the fact I was speeding, but maybe not excessively. Do I have to plead not guilty? Or guilty to a lesser offence? Do I have to dispute the allegation rather than the fine? |
if u were speeding excessively, u deserve it. edit to ur edit. IF u truly believe that u werent doing 122 and officer didnt use a laser. (if u ask for his notes, he wrote what was used) then u could get it reduced at court. |

If I read the ICBC site right, one excessive speeding ticket qualifies you for the Driver Risk Premium, which will be the $368 ticket, plus $320 a year for 3 years. Actually it says "You may have to pay a DRP based on the table below if your driving record shows..." "May" means... may not?? Could I try contacting the officer to see if he would reduce it to the next bracket under? |
That sucks dude. I remember doing 175 in a 90 zone while blowing the doors off gto last summer - cop reduced it to just speeding :) Hopefully next time you are as lucky! |

The fine for excessive speeding is not able to be reduced lower than it is for that speed ($368). If you dispute the ticket in court and the officer isn't willing to negotiate on the ticket, you'll likely be out of luck in terms of fine/points. The quickest fine-reduction-method would be to pay within the first 30 days and save $25 (not much, but better than full price). Or, you can dispute it in court and see what you can do with the justice/office at that time. |
I'm going to try and dispute the allegation and just plead guilty to 21-40 over. I may as well try.. not worth saving the $25 out of $1400. |
$1400? The whole story was not told, then. What other tickets did you get? It is $25 per charge. Whenever I give out that many tickets to one person, I make extra sure my notes are top notch for the probable dispute. And FYI, you can't just chose to plead guilty for the lesser charge & fine instead of the excessive speed. That is something the officer and judge would have to agree to. |
It was simply an excessive speeding ticket 122 in an 80 Sho, nothing else. What she is unclear on is the language on the ICBC website. http://www.icbc.com/driver-licensing...s/risk-premium If you read the third bullet on the chart next to Phase one it says: "one or more excessive speeding convictions and/or two or more roadside suspensions." Since this is an excessive speeding ticket, she is asking if this means she will fall under the DRP. Hope this helps. Thanks for the correction. I wasn't up to date with the new changes ICBC had implemented. From the wording on ICBC's website, it seems as though there is a possibility of only getting the DRP bill once, twice or every three years, depending on your driving history. How they determine that, I'm not sure. |
Just an update for others benefits: The excessive fine does result in the additional fines. One excessive = over 1000 dollars in fines. Even if you currently have no points. Just something to remember. |
Also, starting in 2011 regular offences will be in the DRP program, not just the more serious ones. Which means paying for speeding tickets for 3 years ... no more 3 free points a year. |

ness_71 i'm similarly aged and to your case as well except i had 0 offenses on my liscence before my first/only offense which happened to be excessive speed. I was charged with excessive speed (150km/hr in i think 100km/hr zone) which was arguable because my car can't even reach up that fast pedal to the floor, i'm lucky when it reaches 130km/hr downhill and it only reaches like 90km/hr up steep hill. Your best option imo is to just pay the fine. Here's what happened in my case. Plead my case to cop to lower fine cause i didn't believe it was fair (wanted a lesser charge), car coudln't have gone that fast because it physically doesn't. He was unsympathetic and said no i have to pay full fine and learn my lesson as he had a big smirky grin on his face feeling up his authority. Plead guilty in court and asked for a reduction in fine seeing as how it was my first and only offense, not only did the judge not reduce the fine but they took away my liscence for 1 month saying something about how consequences are to be thought of before actions; leaving me stranded with no way to move my car out of their court parking lot. Yes my liscence was suspended with only 3 points on it they can do that for excessive speed. In the end my fine was $483 under section 148(1). i just paid off my first extra $320 in the first of the three years. It's not "may" it's yes you have to pay $320 every year for 3 years. You landed yourself a $1443 ticket buddy deal with it. Work some Overtime or something. gl hf and GG. |
