Has your Lawyers done anything yet?.....updates etc...?
I think its time to pick up a new lawyer or liase with a canadian lawyer aswell if nothing has been resolved yet...
A few grand in lawyer fees is a bit better than losing out on 40Gs.

but is this guy being criminally charged with fraud at all? Whats the point of suing him if he has no money?

So broke people can just keep scamming people all their lives and not face any consequences? He's 27 with a kid. He has to work some day. His mom isn't going to be around forever for him to beg from and steal change out of her purse.
