What if you brake suddenly but have no real reason to brake and a tailgater hits you? is it still their fault? |

Yeah I believe the rear ender is always going to be at fault, beacuse you weren't 3 car spaces behind, or whatever it's supposed to be. It's not the tailgater's call to decided whether the guy in front braked for a legitimate reason or not. All that matters is the tailgater was too close to give himself enough time to react. Even in multi vehicle accident, if someone rear ends you, launching your car forward to rear end the vehicle in front of you, you're responsible for the vehicle in front of you. Correct me if I'm wrong on that one... |
I would always just say I was a little above the speed limit and I tapped my brakes to slow down, I didn't realize there was someone tailgating that close behind me. Dog, cat, kid on the road is a bit harder to prove, because in that case you would likely be slamming on your brakes. Lots of drivers adjust speed by touching their brakes slightly, totally believable. The multi-vehicle scenario was discussed a few days ago, but no one really knew the exact answer. In my opinion it would be the first person to do the rear end someone would be 100% at fault for all vehicles involved, if your car is being pushed forward how could you be liable. Theres the argument that you stopped to close to the car ahead of you, but a car could be pushed forward a long way depending on how hard your vehicle is hit. |

I get tailgated so much I don't even care anymore. I let them do what they do... no brake checking for me. However in cases where I have to brake, I brake late and I brake hard. If they're too busy tailgating to notice there's a red light ahead and start slowing down... too bad... cuz I have about 10 feet to go from 40 to 0 |
Brake checking is the stupidest shit in the world. I don't know about you guys, but I go out of my way to AVOID accidents. I don't give a crap about who is at fault. |

ya, Snow brings out a lot of stupid drivers. I leave plenty of room in front of me, because some of the streets still have snow and my stopping distance is quite a bit longer. But if you tailgate me, I'm not going to brake check, but I will definitely slow down. Sometimes, I'm not in the left lane because I don't want you to pass me, I'm in the left lane because there is still snow on the right lane... People are idiots; half of them are driving around on all-seasons and don't realize their AWD doesn't help them turn or stop, the other half might have winter tires but still drive around assuming everybody else has winter tires as well. |

I love how it seems impossible to leave a proper distance between you and the car ahead of you without someone trying to cut in that space. It may be what helped create a bunch of these tailgaters. |

Another thing that pisses me off is when you're lowered and driving slow with a manual in a single lane road with multiple speedbumps and a car is tailgating you while driving an automatic with no concern for the speedbumps. |
