car accident question
 
Hey guys I've got a question and was wondering if anyone has had experience with this type of situation and could give some advice on it.

Basically I was waiting at a light and some guy backed into me. Now he's telling ICBC I rear ended him. It's a horrible loop hole in the system.. if anyone can give some advice, it would be greatly appreciated.

Any whitness's? might be a he said kinda deal and if you are lucky its going to be 50/50. either way you are going to be screwed....

+1 to personal car digital video record for situations like this.

Any witnesses present?
Why would the driver just back up? parking? hill start and he moved back?

my guess is that he was too far into the intersection and tried to back up but didnt pay attention

Witness On the side or the back will do

The car at your back can say your car was completely stopped

Side car can see everything

So ya was he passed beyond the intersection line? If so, that is indication that he was trying to back up so not he is not blocking the walk way

He was backing up trying to switch into another lane. No witnesses unfortunately.

Actually... when was the accident and was there any damages to the lights? They can tell by the filiments which lights were on at the time of the damage. This may be able to prove that his break lights were not on at the time of the impact.

It's a long shot but that's the extent of my Car Accident CSI skills.

^ i talked with the adjuster.. he was on my side, but he said there was no way he could tell..

Well like I said an inspection of the cars may yield some information BUT it's probably not worth the expense to do so.

What a piece of shit. I'm always worried someones going to pull that shit on me, so I never go close to the car in front. I always use the "see the cars tires in front of you" that ICBC says to do. No point ever going any closer. If a car is trying to squeeze in the turn lane after a median and me moving up will get him there, he's SOL.

This possibly a long shot but im assuming he wanted to change lanes into a turning lane? Or to make a turn. Icbc usually asks where the person is heading and hopefully with that they can figure out that he needed to make that lane change to go to that destination.

I had the exact identical situation happen to me and ICBC deemed it my fault since there were no witnesses who could corroborate the story otherwise. It was my first night with my new car and I was downtown and a car turned halfway into a lane, I stopped since I couldn't get around him. He changed his mind, started backing out into the street where I was, I LAID on the horn for a few seconds, he stopped, then kept backing up and smacked my bumper. The damage wasn't bad but to date that's my only "at fault" accident on my record and I wasn't even moving. FML. Sorry to hear it dude.

I had a girl back into my car a few months ago (I created a thread about it). When I talked to ICBC, they said unfortunately if the other party claimed I rear-ended them, I was basically SOL as without a witness, they will usually side with the person in front (saying there is no way they can tell if he backed into me or I rear-ended him). Luckily for me, the girl claimed responsibility. Good luck to you!

I have had someone back into me in a parking lot - and I got him to sign something saying it was him that backed into me. It might not be much, but it's better than going to ICBC with no witnesses.

this happened to my dad waiting at a four way stop and the truck in front of him backed into him and sadly he got screwed over. that fucking bastard

^ dont think so, thats like siding with the person they are in the car with usually lol, outside witnesses usually.. see what the guy says hes going, hopefully he fucks up and gg for him

this has happened to two people I know, the first had a witness but the second didn't, I'm pretty sure ICBC sided with him but I'm not sure about the details.
