If you hit someone from behind, is it always your fault?
 

Lets say I'm going down Granville, and someone on the left lane cuts in front of me because another car is making a left turn. I rear end him. Would that be my fault?

Unless you have a dash cam to provide solid evidence to the contrary...

most likely yes.. must always keep safe distance. if you have witnesses that saw the idiot that cut you off... you might have a chance. ull still be at certain % at fault.

If you can find a witness saying the car cut you off or they admit it (or buy a dashcam!) then you won't be deemed at fault

What if I didn't exactly rear end him, but instead hit the rear passenger door of his car? Would this prove that he tried to cut me off?

Not sure what ICBC would say but to me the other guy is clearly at fault

Ya I would agree with MB if you hit the side of the guys car it proves he was trying to get into the lane when he obviously didn't have the time/space.

Broken arrow is correct. If you have video footage from a dash cam of the person cutting you off or a witness from another vehicle then ICBC could deem it the other person's fault. Or if the evidence shows you were going straight while the other person was changing lanes. Happened to me twice. First time the person pulled out from a stop sign and I hit their left corner and the second time the person changed lanes because they were behind a left turner. I was in the right most lane and damage was on the left side of my front bumper while her damage was on he the right side of the bumper.

But YMMV.

sounds like he switched out while you were already beside him

so technically he sideswiped you

I posted this exact same scenario awhile ago. I was in left lane, car two in front of me turning left. Car in front of me pulls out into right lane to get around turning car. Another car in right lane hit the lady pulling out. I gave my information to the girl who hit the car pulling out and ICBC deemed it was 100% the fault of the lady pulling out. If I didn't provide information to ICBC then who knows how they would have decided.

always your fault. 100% ur fault ICBC says if you are the person behind, unless you have witness then best bet is %50,50. I know from my past experience

Just went through this myself. Was in right lane going straight. Idiot in left lane switched lanes as he didn't want to wait for a left turner. I was going 50.. I imagine he entered no more than 20km/hr.. I slam on brakes, my front left bumper hits his back right bumper.

Thought for sure 50/50. Icbc called me the other day, found the other guy at fault.

When you talk to them, draw them a diagram. Also, it sounds like he changed lanes into you. Don't say that you 'hit him from behind'. Reinforce that, trust me. Tell them he merged going too slow without shouldeer checking.

But, I think in my situation he was given fault because he CLEARLY lied to the adjustor.

I witnessed a guy cut someone off, then purposely jam on the brakes in order to cause an accident. Of course, the accident happened... minor as it was, I still stopped and gave my name and number. ICBC did call me to confirm the story.

I imagine if I hadn't given my name and number, that the guy who caused the accident probably would have gotten away with it!

Usually you're 100% at fault according to the Motor Vehicle Act. However, if you can prove the damage on your vehicle and the other matches the situation then you may be lucky for a 50/50. But from past experience, ICBC does jack shit and your only way out is if there's a witness, cam, or if the person admits to cutting (which they won't :troll:).

That's not a fair statement. In both of my cases I was certain I was gonna get shafted by them but both times they came to conclusion the other person was 100% at fault pretty quickly based on where the damage was on my car in relations to the other car. Or maybe I was lucky both times.

happened to me too.. fucking old E. I. scum... I have fast reflex, so I was able to avoid accident but he clearly slammed on break to cause accident. I was so furious I chased him down, he started running away weaving in and out of traffic. When I finally caught him by the red light, I walked to him and he ran away running red light. That dumbfuck should never be allowed to ever drive again..

^ Would getting the License plate and reporting to ICBC or VPD do anything? I mean its obvious hes purposely trying to get into an accident.

I ve seen dumbass c-lais that does that, not to cause an accident on purpose. but actually stop because shes spooked and frightened from the incoming cars.. :rukidding:
