Nah, to me I feel it's legally the van's fault. Motorcycle had right of way and IMO the van needed to pick a safer gap before entering; by safer I mean the traffic your merging too doesn't have to slow down for you in order for you to enter their lane.

However, just because the van didn't legally have the right of way doesn't mean one should stop riding defensively. It probably could've been avoided but feels like this one is still on the van on my books.

It may be legally on the van but at the end of the day he's protected by a cage. Had the biker just hit his brakes everything would have been fine, but no he tried to make it and failed. He's lucky he wasnt more injured. So down the road even if the van was "legally" at fault and the rider has a limp for the rest of his life because his legs fucked up, probably going to think twice.
