LOL @ taking off license plate. Its not like u dont have to put it back on later. Especially when u drive a blinged out surrey special mercedes, cant be that hard to find.

IMO why not just find another spot to park? Its superstore theres spaces everywhere. Not worth it now since theres gonna be a claim on the car.

In a comprehensive claim, the OP will need to pay ICBC the deductible regardless.

^icbc may elect to pursue the guy for their costs and if they recover, the "victim" would get his deductible back. The kid doesn't need to be convicted criminally for a civil case. Standard of proof is a lot lower in civil court, as judgements are made on the "balance of probabilities" not "beyond a reasonable doubt" like they are in criminal court.

They may be able to put it under his liability policy, just depends how far they are willing to stretch the definition of "use and operation of a motor vehicle"

yes but chances of that happening in a case like this are slim to none. the costs involved would far outweigh the cost of the claim.

Shit like this makes my blood boil. Yesterday i was driving down commercial / broadway around 9pm, a person walks across the street while texting on his cellphone on a green light. I honked at him and he gave me the finger and started swearing at me. Fucking people....

Hey I just spotted this guy. I was going north around 620pm on ironworkers bridge and he blew past me in left lane. Still no plate on the back.

I was already above the limit so he was definitely flying. Then watched him cutoff a couple cars in order to take the exit towards the same superstore and deep cove. I unfortunately caught the red light and he was long gone.

Seeing how this guy drives makes me even angrier. Haha

this is without a doubt a claim that falls under comprehensive coverage.
Which costs are those? Assigning the claim to a staff adjuster and getting him to send a letter to the kid saying he owes ICBC $2500 for the damages caused? They would also not let him get insurance or renew his license if he owes them money...

I know it would fall under the Jeep's comp coverage. I was talking about ICBC opening a claim under the kid's liability policy. That would be a very technical discussion and I don't really want to get into it, as there's no need for it in this thread.

Just to make the stupid little cunt pay, I would take his ass to small claims court and make him pay for the damages directly.

Its like $100 to file a claim, and you can collect up to 25K.

Not hard to demonstrate a couple thousand bucks worth of damage when the car has even just 4 panels that need to be re-painted.

Yeah he took the guy to court on a sunday night all while under the supervision of the ICBC tactical squad who is available 24/7

In a situation where ICBC has to pay out on someone's behalf, but then finds this person was in breach his insurance policy (eg crashed while impaired, didn't declare correct principal operator, etc) then, according to the insurance act, ICBC can send a letter demanding repayment.

But in this case, ICBC can't just send a letter because it has no grounds to demand the kid repay the OP's claim. This is a criminal and/or civil case between the OP and the kid.

If ICBC wants to recover the costs of the claim from the kid, they would need to pursue it in civil court which will involve way more than $2500 just in legal costs. On the other hand, if a judge finds the kid guilty of criminal charges, he can then order him to repay ICBC in the form of restitution.
