Neighbor purposely threw a rock and cracked my house window
 
Hi peeps,
Last Thursday around midnight, there was a big bang on the window which woke up the whole family. As we checked our camera footage, we saw our neighbor was walking toward our fence and threw a rock at our window which crack our window. (Everything was caught on camera)

As we were in total shock, we quickly called the police. After the police viewed the footage, she went to the neighbor's home and arrested her. However the neighbor was released on paper right away.

The reason for her to target my house, I believe it all went back 3 months ago, when she first came to me to complain that every Thursday and Friday, the start up sound of my exhaust made at 8:30 in the morning which woke up her son and of course her. However my car exhaust is stock and at 8:30 in the morning we need to take my son to school. Therefore I told her there's nothing I can do to avoid not to start the car at 8:30 in the morning.

After this window event, both my son and my wife are totally paranoid about every little sounds they heard. Especially my son wouldn't go sleep in his own room anymore as his room is right beside the cracked window and he is really afraid "the bad guy" will crack his window at night time. And now I really have concerns about the safety of my family and my property.

Has anybody experience this kind of stuff and end up going to court? If the neighbor hires a lawyer, will she then get away with no record under her name even though we have the evidence that it was her doing?

I understand the frustration of having kids being woke up by neighbours making noise (I have a neighbour who mows his lawn around 9PM in summer months) but I don’t think you can complain about noise at 830AM..

As for your wife and kid, I imagine after having to deal with the police it won’t happen again seeing as she was caught. Explain that to the wife and maybe tell your kid it was a bird dropping something from the sky or anything somewhat believable like that. My kids would probably buy that story and relax but they’re also gullible like their dad :badpokerface:

I've never been involved with anything like this, but if I were, I'd consult a lawyer to see what the possibilities are.

In my opinion you have a pretty strong case, since you have video evidence of her terrorizing your family.

8:30am is late?!?!? wtf! I get up at 5:30am and leave for work at 6am before. No one ever complain. Even now I live in apartment when I take the elevator is pretty loud and I am sure the unit that's closest to the elevator don't complain.

Was she actually arrested or just detained and brought in for questioning?

she was arrested for criminal offense - mischief but released on paper with appearance notice to show up in court on the given date

In all seriousness, seems kind of excessive to destroy someone's property. I'm not sure how does breaking someone' window solve the noise that bothers her...Stupid idiots.

People out there are so whiny, yet don't look up the regulations. Don't even know on what grounds they even have to complain about something.
Sorry that you have to deal with this kind of shock, Hope they fine her ass real bad.

For you guys future references, just look up the applicable noise bylaw for your city, and then there's no confusion.

Anyhow it seems like for the most part, noise is allowed starting at 7AM, if not, then 8AM

If she was charged criminally with mischief, I'd say that's pretty significant and she will have to deal with that. If she hires a lawyer to defend her, it won't come cheap to her, which at least is something. With the video evidence, almost certainly she'll be told to plead out. She may receive a fine, probation, or who knows. Criminal record is 50/50, the judge might give her an absolute discharge if it's a first time offense. Regardless of what happens in the criminal case, you can pursue her in small claims court to be reimbursed for the repairs.

To be fair, the STI is very loud for a stock car. This lady needs to know that the world doesn't bend to her circumstances.

Is there any prove we can provide that she won't get away with a discharge? I really need her to learn a lesson about damaged others property

That's not really up to u, that's up to the courts.

You did your part well by catching and reporting her already. Don't be vindictive. Just feel sorry for her that she lacks the wisdom to resolve this in a peaceful way. Now, she has to suffer the consequences.
