WITNESSES WANTED FOR ACCIDENT ON KINGSWAY BY 12TH (FEB 21) (KINGSWAY)
 

Hello,

I got in a car accident on Kingsway after turning in heading Eastbound from 12th. At the position of the accident, the Toyota Dealership was on the left side to get an idea of location. The time of accident was 6:12pm. I was in a car 2014 Scion-FRS grey on the left lane, there was an older 20+ year Toyota Van greyish blue in the middle lane. He was positioned next to my car slightly ahead of me so I was positioned in his blind spot. Without warning and signalling, he had began to change and turn left into my lane. I held onto my horn but he did not stop and end up denting my front right side and scraped all along the front fender and bumper.

We had exchanged information and I had called ICBC shortly to report the incident. When ICBC reached out to Duc Toan, he unfortunately made up a story and said I had skidded out of control and crashed into his lane. As it is my word against his, ICBC cannot help further to assess liability unless there are any witnesses that come forward.

As I was panicking at the time of the accident, (my first accident :(.. ), I had not thought of flagging down any witnesses to record the events. If you were around this area and had saw what happened, please reach out to me by email or phone and I would be so thankful. There must be good people in this world!!!!

In photo #4 you can see tire tread marks leading from the right lane into the lane hes in which indicates he moved over.

I'll assume you both stopped basically once contact was made. If this is the case those must be his tire tread marks as if they were not there would be a straight line through them if his vehicle was going straight in your lane according to his story.

This is a bit of a long shot but hope it helps.

Yes thats what I thought initially but where the van is there should be a tire mark that runs straight down the road going over the one I highlighted.

RS Detectives never ceases to amaze me

I call bullshit on icbc. If they cannot determine fault on stories then they have to determine fault based solely on evidence. Showing the tire tracks in 2 of your pictures, it shows no swerve marks and clean lines to pulling over to the side, so less likeley of skidding. On top of that, your frs is pulled further towards the median than the other. This would coincide with your story that the other car moved into your lane because instinct would make you hit your brakes and veer away from him. Lastly! If you did swerved into him from snow on the road, you would be more likely to have greater damage on the front right corner of your car and judged by how close you are to the median, you might have suffered some curbbage on your left rear. Of course the third one depends on the actual damage to your vehicle and his.
