You are almost always allowed to pass on the right. If there's a lane on the right you can pass unless there's a specific sign or area restriction.

You can't legally pass on the right if you actually have to drive off the road (on to the shoulder of a highway, for instance).

The left turners fault. His vision was probably blocked by the cars on your left side turning left (the green cars in your diagram) so he made his left turn without checking clearly and didn't see you.

And as you can see on the map, it clearly shows it's a 2 lane traffic.

Is this like 62nd and Granville? Looks like it's close to the collectibles card shop I go to.
