I hate the media.

Notice how at the end of the clip, she started with "honestly, probably gonna pay the tip anyways..."

then she got muted and the news reporter started talking.
Bet they can make a story out of that, or start throwing things in people's mouths by taking things out of content.

wow thats fucked, since when is tip mandatory? if I dont like the service then I aint tipping you shit. You earn it, its not given to you just cuz I sit down and eat.

i've seen lots of places in canada do the same.

But it's usually for large groups of people. They automatically add in the tip on the bill.

Still probably not mandatory tho...

But the lady is dumb... she says:

“I understand that, you know, we didn’t pay the gratuity, but it was a gratuity, it wasn’t something that was required,” said Wagner.

Well bitch, thats where you were wrong... it WAS required... and you got your ass tossed in the back of a cop car.

still sucks tho, but it was completely her fault

Wow unbelievable.

The mandatory tip mainly protects the server from cheap people.

When large groups go into restaurants, the majority of the people will pay their portion + a tip. If their meal was $15 and they leave a $4 tip, the amount on the bill is reduced by $19. But some cheapasses wait till the end to ask "how much is left on the bill" and will just pay the remainder without tipping.

^ Not sure in the states, but 15%-type tips are only mandatory in many places here (BC) in groups of 8+. Maybe some places have mandatory tips for even small groups? That would suck.

Have had restaurant staff chase after friends and I and ask where their tip was. We just told them that they provided horrible service.

^this happens at chinese restaurants all the time. you get ZERO service and an attitude and they expect tips. i just walk out and pay the bill exact when this happens.

honestly restaurant servers say that tip is mandatory because its such a hard job!
i think thats bullshit considering how much harder a lot of people out there work for $8-10 an hour!
if you think this is the hardest job for minimum wage then you obviously dont know the meaning of hard work!
and before you judge yes i have worked as a server and a delivery guy before!

"Pope and John Wagner were hauled away by police and charged with theft for not paying the mandatory 18 percent gratuity totaling $16 after eating at the Lehigh Pub in Bethlehem, Pa. with six friends."

They had a group of eight, which usually means that gratuity of 18% is added automatically to the bill.

I don't know what the rule is.
But most places don't put a gratuity (tip) % or value.
In those cases, I usually tip 10%.
I may pay a bit more than 10% if the service is good, or if service sucks, then less than 10%. There has been cases where I paid 0%. They didn't and can't do anything about it.

But for English restaurants that have a big party of like 10+ or something, they will add on a +15% gratuity. And it's part of the bill. When it's in those cases, I think it's mandatory to pay.
As the final TOTAL on the bill has the gratuity already calculated in. Just pay the exact total shown on the bill and you're good.

That still doesn't mean you absolutely have to pay for it when the service is shit. There's nothing I despise more than getting bad (not meh, but BAD) service when I'm eating with a group of friends and they tack on the mandatory large group tip. I DO understand that there's more work involved catering to bigger tables and more people but that's still no excuse for slacking off and giving poor service just because you know you're guaranteed to get a tip from that table at the end of the night. I'm sure that if service was bad enough and you complained to management hard enough you probably wouldn't have to pay the entire amount.

I've never argued against a "mandatory" group gratuity when the service was bad, although there have been plenty of times when I probably should have. Has anyone here ever tried?

The case captured nation attention and bought into question whether customers should pay a tip regardless of the level of service they receive.

NBCPhiladelphia.com received more than 3 million hits for the couple's story alone and more than 2,000 viewers left their comments about the incident.

An attorney for the Lehigh Pub said he was a bit surprised by the news.

“We do not agree with the facts as presented in the press last week. Sheenan told the Morning Call. “This is the subject of an ongoing investigation by the Bethlehem Police Department, not Lehigh Pub, and we will defer to them as the legal process plays out.”

Both Pope and Wagner are expected to appear on CNN Tuesday.
