^i think it would be the cars fault because as the driver your supposed anticipate it
So if you're driving along at 50kmph, and up ahead there's someone standing still by the curb as you're approaching, but without warning suddenly decides to step out when you're five meters away before you hit him, you're at fault?

as for people cross when ever they want bicyclists are the worst for going when ever they want
i don't think so.
if a pedestrian j-walks and you hit them.
you aren't at fault. or if they cross when they're not supposed and you hit them you are still not at fault.
that would be ridiculous if drivers are expected to always anticipate stupid shit pedestrians do.

That's exactly it.
A few years back during the Langley Cruise-In, a pedestrian was struck and killed while trying to cross the Langley Bypass (a very, very busy road for those who don't know it) in the dark. The driver was deemed to not be at fault because this person simply tried to run across the road without looking for oncoming cars.
It's hard to be tried for manslaughter (even involuntary manslaughter) when the other person is doing absolutely nothing to prevent themselves from being hurt.

I've mentioned 2 cases. I'm sure I can dig up more.
Logically you are 110% correct, but something is a miss with our legal system.

I'm unfamiliar with those two cases, so I don't know if the drivers were charged or not. I was simply talking about a case I knew because, unfortunately, I was there when it happened.

The driver was charged with vehicular manslaughter because he ran a yellow light while doing 60 km/h trying to beat the light on a dark rainy January night. The pedestrian was wearing dark coloured clothing and started to cross on a red light to catch the bus at Nanimo skytrain station.
In the end, the driver was aquitted, but not after suffering verbal assaults from the deceased parents/friends and suffering through the trial.
The other case involved a mother and baby in a stroller who was walking on Pacific blvd because the curb was blocked off due to construction of a apartment. Somehow, the driver ran over the baby and stroller and knocked the mother down to the ground.
The said driver is currently awaiting trial on his vehicular manslauter charge.

LOL if it was the car doing the hitting everyone would jump on the driver. Why would the cyclist be treated different?
Pedestrians hate Motorists, while they hate Pedestrians although everybody HATES CYCLISTS!!! RIP
Pedestrians don't hate motorists. 99% of drivers are pretty predictable. The only ppl saying pedestrians hate motorists are the cyclists cuz they want to point the finger the other way.

Off topic but when I walk to work there is a bike lane but cyclist never USED IT!
They would either ride on the sidewalk going really fast and if you don't move they just keep going. Or they like to ride on the lane where the cars are driving O_o what gives?

More like all cyclists should get insurance, registration and be subject to (and enforced) the same penalties as car drivers.
You want to be part of the road, pay up like everyone else.
iirc:
if the cyclist has a bc license and has a car insured with icbc, and if the cyclist is found to be at fault, i think icbc can go after that (in a limited sense) on the pedestrian's behalf.
also, if you have a bc license and are a pedestrian, and you get hit by a car that isn't insured or doesn't have enough insurance, you are still covered to a degree.
While i'm a biker myself, Whenever I see idiots riding on the big streets like main or grandview I make it a point to get as close as I can go them without clipping them.

not what i meant by it cuz obviously theres no way u can stop in time
im just saying that ur supposed to be aware go and look at a learners book
i totally agree that a lotta old ppl break the law, old ppl can die easily etc. but if the cyclist was going a safe speed, with proper equipment, he would see properly and not crash. No excuse.
Hopefully this causes some sorta restriction in bike lanes and cyclist laws. Would make no sense, but i'd love that for selfish reasons - i hate cyclists
Unless you peds start shoving cyclists onto the bike lanes or knocking them off the bikes they arn't going to use them.
I can't count how many times i've nearly slayed some jerkoff who was running accross an intersection on red or turned red but still gonna keep running trying to make the bus fucker. Guess I can be thankful that these same idiots dont have a DL to drive....
