for real... this guy has been nothing but problems... |
He's your tenant, which means you are the landlord. Give him a notice of eviction, as he hasn't complied with his rental terms of agreement. ....or, you have a spare set of keys that you can use to move everything of his outside onto your front lawn and change the locks. :p ...and why is this in VAC? |
the thing is we are not realy renting out legaly.... i am not the lanlord, my mom is and we think he scammed out my mom(to long of story)... would we still be able to evict him or no? |
Yea immediately serve him a notice of eviction if the agreement said no smoking with his signature. He'd have to move out after 30 days I believe. If he's not home or avoiding, stick it to his door--it'd be deemed served after 3 days. You can only evict him immediately if the situation is extremely serious--which it is not. Even then you'd have to give him 5 days? And he can dispute it which is troublesome. Just take it for the next 30days. You cannot kick him or his stuffs out yourself though or even changing the locks, that's illegal and you'd be in big trouble. |
Yeah, just tell him he's out of there. And bill him for the carpet cleaning. Is this a legal suite with a contract? If so, is there a no smoking clause? If not, or it's an illegal suite you're out of luck. |
And I would suggest giving him notice that you will be entering the property and before you give him his notice, take photos with date stamps of the whole place. Best to use a newspaper with the date just to be sure youre time stamp won't be questioned. |
he said it him self, its illegally rented |
If you own the property, yes, you can kick him out. |
is stink bomb still my only choice? |

The tenant in the illegal suite, ironically, is covered by every rights in the tenancy act because the agreement between you and him itself isn't illegal. I hate fuckheads like those. They're one of the reason why it's sooo hard to find a decent place that is priced reasonably. They should all be fucking shot. http://www.rto.gov.bc.ca/documents/GL20.pdf Call the info line of residential tenancy branch? |
You can lie to him that you are selling the house. New owners coming in on XXX date. I don't know, never rented or rented out before. |
yea i dunno maybe stink bomb isnt the right choice... i just thought since he stunk up the house, how would he like it if his room got stunk up... honestly i dont mind the smell of ciggs but the ciggs he smokes are STINKY i dunno wtf he is smoking, must be some cheap ass tabacco, id honestly rather smell someones b/o well maybe not.. but thats what it almost equals to... |
LOL. Why would you want to plant a stink bomb in your own property :troll: |

i am starting to think maybe the stink bomb is the right choice... of course take the stink bomb package out of his room after its deployed.. unless u want ur ass beaten or sued lol... hopefuly this thing wont stink up too bad, i dont want it to stink super bad, but just enough to stay in his room for a day or 2 lol... or i could be a noisy fucker and try to get him to move out, maybe i should start thowing partys in my house woohoo |
