yes, as long as you have the key in your possession and are inside the vehicle...in your possession as in, in your pocket, the glovebox, the trunk, the hood, under the seat, in your partners pocket....you will get a DUI because you can be in care and control of a motor vehicle

There are vans that are not wheelchair accessible therefore they have the full seating capacity, ask the taxi cab company or try another company...

:seriously: Lucky me for not getting a dui then... but that hardly seems fair. I choose to do the right thing by not driving drunk and sleeping in my car till I'm we'll enough to drive and I can still loose my license. it seems like even when i try to do right I'm still doing wrong.

It's actually at the officers discretion if you pass out in a car, it's been discussed in the police forum.
