I failed you because YOU parked in a parking lot that was reserved for customers of ABC business. It doesn't matter if ABC closes at 5pm every day. It is their lot and if you are not an employee of the company, an owner, or anyone doing business you should not park there at all. Ticket seems valid to me.

that's your decision but i'm figuring the lot is private property so they'd have a right to ticket or tow or whatever their warning at the lot states.

I failed you because the ticket stated that the customer did not shop at ABC business, but ABC business is closed. From what I understand, if no business is open in said parking lot then nobody can use the lot? So we just have an empty lot that will only be used during business hours? If it's a paid lot, then that's a different story, but iirc the lot is free so DPS nor the business stands to lose any money from someone parking after hours. Seems pretty douchey to me. Sure it's in the legal right of DPS, but if everyone just strictly followed what is in their legal right then the world would be a pretty ugly place. Sometimes we need to lookout and be nice to our fellow people.

That's right.

Bottom line: it's private property, and the owner can set whatever rules he/she/it wants for its use. If they want it to sit unused 24/7, that's up to them. You may feel that you have some god-given right to use someone else's property for your own personal parking space, but that ain't how it works.

It's no different than if I decide I want to come park on your lawn while you're not home - I mean, why should it matter? You're not there, and it's more convenient for me, so why should you care?

I would only agree on it if it was the owner of the business CALLING DPS to tow me or give me a ticket.

But it was just this kid walking around thinking he is tough shit and ticketing everyone.

This guy is known to do this on a regular basis, and I have actually went and talked to the owner of the business since this event.

The owner actually think it's ridiculous and is complaining to DPS for me.

Obviously not all lots are the same... but you don't know if the owner of a particular lot has TOLD the parking company, "Enforce this 24/7", or "Only enforce this during business hours."

That's a different matter, if DPS is acting contrary to the property owner's wishes.

The fact remains, it's private property, and it's the owner prerogative to set whatever rules he wants for the use of it (within legal limits, of course). One can't simply ASSSUME that it's okay to park there just because the business is closed.

The whole point of giving your lot to a company like DPS or IMPARK to look after, is so that you don't have to sit there and survey everyone who parks there and determine who's a customer and who isn't, and call someone yourself, to have them towed or ticketed accordingly.
If the owner of the business you're referring to owns the lot; then if he feels truly outraged by what happened to you, he'd tell DPS to fuck off.
If the owner is just renting store front; then what he thinks doesn't matter two shits. Cause if the actual owner of the lot doesn't want you parking on his property, it's his fucking right.
