The B.C. government has introduced legislation to ban B.C. drivers from chatting on cellphones while they're behind the wheel.

Six other provinces already have such legislation in place.

The B.C. government promised in its throne speech last August to restrict cellphone use while driving to create a safer driving and pedestrian environment across the province.

Solicitor General Kash Heed said Wednesday that the Motor Vehicle Amendment Act changes to crack down on cellphone use will save lives.

"We have all seen near misses on the road because drivers were not paying attention," Heed told the legislature. "And some of us have seen the devastating consequences of driver distraction."

If passed, the changes to the Motor Vehicle Act will take effect on Jan. 1, 2010. At that point, only hands-free cellphones and devices that require one touch to activate will be permitted.

A new fine of $167 can be handed out as of Feb. 1, 2010. If drivers are caught texting or emailing they will also receive three penalty points on their driving record.

New drivers in the province's graduated licensing program are not permitted to use hands-free phones and will receive the $167 fine and three penalty points for any violation of the amended legislation.

The B.C. Association of Chiefs of Police passed a resolution earlier this year asking for a total ban on cellphone use by drivers, even with hands-free devices.

The Ministry of Public Safety and Solicitor General said independent research concludes that cellphone use while driving is the top cause of distracted driving.

On average, about 117 people die each year in British Columbia and 1,400 are sent to hospital because of distraction behind the wheel said the ministry.

BULL FUCKING SHIT. They might as well give tickets to those who are checking out JB ass instead of looking at the road.

Talking on cell isn't banned. You just need to use some sort of hands-free device to make calls.

ive got no issue with it, although its kind of stupid to ban even handsfree phones from NDs

Sounds good to me, too many bad drivers on the road making dangerous maneuvers while talking on their phones..

talking on the cell phone should be banned. there are way too many bad drivers out there, and they shouldn't be on the phones while trying to drive.

People who are usually used to driving with both hands on the steering wheel especially shouldn't use a handset and try to drive. They CANNOT.

You have many options - buy a bluetooth headset for $29 that you slip on in the car. Or buy a nice deck that has bluetooth capability. Or GPS that has bluetooth (GPS's are arguably equally/more distracting, buts lets leave that discussion for another thread) There have been way too many accidents due to people on their handsets and driving at the same time. Get off the fucking phone and drive please. KThxBye.

uhhh didn't they remove the penalty points system?

the ban doesn't go far enough. studies have shown hands free talking to be distractng and dangerous. before anyone tries to compare hands free to talking to a passenger in the vehicle there is a difference: with a passenger, there is more likely a chance you can talk about the hazards and current driving conditions. this keeps the driver more aware of his surroundings than someone on the other end of a phone. what happened to all the people who said they would safely pull over to the side of the road to take or make a phone call?

I agree with the fine.

But fuck the government for making it a 3 point offense.

Can't wait to see all the cellphone talkers and texters get suspended.

people won't give a rats ass about a $167 fine but they will if its also 3 points in the system

Why don't we start banning people eating with 1 hand and driving with the other as well as chicks doing make up while driving. I constantly see idiots like that on the road do stupid shit too.

I think they need to up the fine from $167 to $761 and the points to 6 points on the license. Too many stupid wankers who can't breath and drive an automatic at the same time.

All for this new legislation.

uh doesn't matter, everyone is still gunna use their phone while driving.
