^ If you search for “permit” in this thread you’ll find many posts discussing this topic and it was unclear, but some people have received VI’s with a TOP so yes they can do it.

I got a VI with a temporary permit. For what it's worth, this happened in January 2014 so I don't know if that has changed since then.

Why not? They're insured and on the road just like any other car. There is no difference between a plated car with the insurance expiring tomorrow and a temp insurance expiring tomorrow.

Exactly, because if it is registered in ICBC you can mess with the car. May be cop would be lazy a bit, because it may be point a to b insurance, and that insurance does not require the registration.

I'm asking because I'm picking up my imported vehicle from the docks. Technically the vehicle isn't registered in BC since it hasn't had it out of province inspection. I would be getting a temporary permit to allow me to drive the vehicle to an inspection facility. I was wondering if they are able to issue a VI under those conditions

See these resources;
CVSE - VIP eForm System - Known Issues

Under "Vehicles Excluded from the Vehicle Inspection Program:", it says;
"Vehicles operating under a Non-Resident permit (Section 6(7) of the CTA) or a Temporary Operating Permit (Division 14 of the MVAR)"
-> Division 14 of MVAR talks about TOPs.

Also see MVAR 25.01 (2) (d) regarding Vehicle Inspections
Vehicle inspections apply to....
"(d) a vehicle, other than a motorcycle, the operator of which is required to hold a licence under the Motor Carrier Act or a licence or temporary operating permit under the Passenger Transportation Act,"

Now... I'm NOT a lawyer, but my understanding based on the above resources are that TOPs are excempt from VIs. I asked the opinion of a lawyer as well and she agreed with me, but gave the disclaimer that there could be something else deeply buried in the MVA and MVAR that contradicts this and that an officer could interpret (however they want) to contradict the resources I outlined above. I wouldn't be surprised by this given how poorly written the MVA / MVAR are.

Then again, I would not be surprised if Mr. Fav officer completely ignores these rules and regulations and issue you a VI anyway. Whether you would be able to take the VI to the chief of police and "dispute" it and make a case about it by quoting the above resources, is a completely different story. I'd say it's worth a shot anyway if anyone gets a VI with a TOP.

I got a "unnecessary noise" ticket DT a couple weeks back, but no VI, it was a bike cop. I thought it was a bit silly since I was underneath the overhead structure of the lawcourts at smithe and robson, so lots of reverb, and I wasn't pushing it or anything.

You're worried about getting an order to get an inspection while on your way to get an inspection. :badpokerface:

I never said I was worried. I just would like to know if it's possible to get a VI under those conditions.

westopher 05-22-2019 10:44 AM

It wouldn’t really matter, would it. It’s not like that would mean you have to get two.

Not unless he gets a box 1 and all of a sudden he needs to pay for a tow...

But the only way to avoid that is to also pay for a tow so...

I have a silencer on one of my gasoline cars. You still hear the rumble in the cabin windows rolled up which is kinda nice but outside it sounds stock. :lol

Needless to say he is disputing it. Since when do CBSA officers have the authority to issue RCMP tickets to cars that aren't even in the country yet???

I'm pretty sure CBSA badges are only 5 digits.

Perhaps there is more to the story?

Depending on the POE (usually commercial-designated POEs), CVSE has some presence as they inspect trucks that are coming in to make sure they are compliant. Maybe it could be them?

Kaolinite 05-27-2019 05:03 PM

^MVA is provincial act so all peace officers have authority to issue tickets. Also, isint the giant arch at Peace Arch Crossing the official "boarder" or Canada/USA? So in the line-up to enter Canada, you're technically already in Canada.

98% of FRS and BRZ on the road deserve one.

^ Not really true but funny. Same for the Nissan 240 and that type of car when driven by teenagers or people that act like teenagers.

Skunkworks' E30 with a slight exhaust has been VI'd

Jackp0t's 1 series has been VI'd

There was another black 1 series that was VI'd.

Plenty of reports of Porsche's and BMWs with MPE being VI'd as well.

How loud is your exhaust?
