TSN reporting that Montador is a plaintiff in the concussion case vs the NHL

Montador was plaintiff in concussion case, estate may pursue claim - Article - TSN

Quote:

Steve Montador, the former Chicago Blackhawks defenceman and expectant father who was found dead in his home on Sunday, was a plaintiff in the concussion case against the NHL, TSN has confirmed.
Police have said they do not consider Montador's death suspicious and it's unclear whether the cause of his death will be publicly disclosed unless his family decides to reveal details.
Autopsy reports in Canada tend to be covered by privacy laws, and wouldn't be disclosed to the public unless it can be established that their release would serve the public interest.
The 35-year-old Montador was suing the NHL three years after he last played in the NHL. He suffered a season-ending concussion during the 2011-12 season while playing for Chicago.
Montador was plagued by concussions through his hockey career and after last playing in the NHL spoke frankly about the injury and subsequent depression.
He played 571 NHL games with six teams, scoring 33 goals, 98 assists and had 801 penalty minutes over 14 NHL seasons. He was a key member of the NHL Players Association's bargaining committee in 2012.
Montador's family will be able to pursue his claim against the NHL on behalf of his estate, his lawyer Bill Gibbs told TSN.
"Steve was still struggling with the aftermath of a lot of post-concussive symptoms and I think he was very concerned about what may lie around the corner as he aged and the concussions caught up with him," Gibbs said in an interview.
"He was a guy who really cared about his brothers, the guys he played with, and I don't use that term loosely. I think he felt strongly that it was important for everybody to start advancing the conversation about what happens to guys after their hockey careers and what happens to their brains."
Montador, who was expecting to become a father in about a month, was among more than 200 players who are said to be involved in litigation against the NHL relating to concussions.
Montador joined the lawsuit about a month ago, said Gibbs, who also is representing the family of Derek Boogaard.
Boogaard, who was recovering from a concussion, died of an accidental overdose in May 2011. His family has filed a wrongful-death lawsuit against the NHL, blaming the league for brain damage Boogaard suffered playing the game and for his addiction to prescription painkillers.
The NHL has claimed in legal pleadings that former players who are suing the league over how it handled concussions and head trauma injuries ought to have been able to "put two and two together," thanks to newspaper and magazine stories and other news reports.
Lawyers for players including Joe Murphy, Bernie Nichols and Gary Leeman rubbish the NHL's claims, saying players had "no knowledge of the medical literature, and no understanding of any need to go find it because they relied on the NHL for information about player health and safety."
The players, whose claims have not been proven, allege that the NHL did not do enough to protect them from head injuries before it created a committee to study head trauma in 1997. Even after that, the players charge the committee's findings were not adequately shared with players.
A Minnesota judge is in the midst of deciding whether to allow the former players to pursue their claim in court, or whether it should be decided at arbitration.

so I hope this isn't another player to go down ala Rick Rypien :(

Thankfully its not, they said it was natural causes but are performing an autopsy since he passed away so young.

I'm watching the last 2 minutes of the Washington/Anaheim game and the refs totally blew a call.

Anaheim is down 5 -3 with the net empty. The Washington's Beagle is racing down trying to get a breakaway on the empty net. He is brought down by a hold and another Washington player gets the puck and attempts a pass. Kesler reaches out and deflects the puck into his own net.

Goal is waved off because the play was blown down. Play was blown down because the puck deflects off of Kesler's stick but he never gains possession of it.

Holding penalty is called instead of an awarded goal since the player was going in on an empty net.

NHL :failed:

jeedee 02-15-2015 06:56 PM

Isn't the same thing applied on a delayed penalty?

When a puck deflects off and goes onto the delayed penalized teams stick--play stops.

I could see why the refs called the holding penalty rather than the goal cause the puck touched Keslers stick [delayed penalized team] first before it went into the net.

Oh well, Caps still won 5-3 [in the end rather than 6-3] not like that goal really would've decided the outcome :lol

Rule 15.1 Play is stopped when the offending team gains possession of the puck.
Having the puck deflect off your stick isn't gaining possession.

From your example, if there is a delayed penalty, then play should be stopped when the goalie makes a save and leaves a loose rebound.

In regards to the Kane shootout goal...

"A few dozen stick handles.." pretty much. Great hands

Biega called up. Hopefully Edler not out for long.

6o4__boi 02-16-2015 09:31 AM

Reading the papers and lol at anyone who thinks Canucks should get a dman for depth in case Tanev/Edler out long-term.

Fuck it, if anything it's a sign.
What exactly is the point of trading to try to make the playoffs when everyone knows it'll take the second coming of Christ to get out of the first round?

This is how rebuilds get fucked up. The worst thing Benning can do is think short term and try to make the playoffs via a stop gap.

I'm really hoping he stays put regardless of injuries. For the first time in a long time we have decent stock of prospects and pick. Fuck the playoffs, I'd rather miss it than Fuck up the future and lose in the first round.

Easier said than done. It will depend a lot on what ownership says. Playoffs = extra revenue for them which means more profit.

Why did we have Tortellini as a coach last year? Cause ownership bought into what he was selling.

6o4__boi 02-16-2015 09:49 AM

I'm hoping ownership just accepts things for how they are and not step in.

If ownership favors profit over everything then we're doomed never to see a cup.

+1. If I remember correctly, Aquilini told the media during a press conference about Linden or Benning's hiring that he is giving "full autonomy" to the president/GM for hockey related matters.

Aquaman needs to do the right thing and let Linden and Benning to their job. Let the people who know how to run a hockey team make the decisions.

Aquaman should stick to running his blueberry farms and other lines of business. :smug:

Long term profits mean more than just one round of playoffs.

Spoon 02-16-2015 10:13 AM

Whether we make it into the playoffs or not we'll be stuck in the middle of the pack. Moving up or down a few spots in the draft isn't going to make or break you when you're the 15th pick or something. So in the eye of ownership, it makes sense to make that playoff run and get that 1st round playoff money. There's not much to gain by tanking this late into the season.

carisear 02-16-2015 10:17 AM

I don't want to f up our future, however if some minor tweaking will get us into the playoffs, then do it.

There's nothing more exciting than going in as an 8th seed and winning. All you guys are positive that we won't win even if we get in, but hey, anything goes in playoffs.

highfive 02-16-2015 10:50 AM

I really don't think Benning is going for any rentals at all. He consistently said that this years draft is good and he see a lot of good players that's going to fall into the 2nd round.

Reading that Lack or Markstrom will be most likely traded near the draft rather than trade deadline.

pastarocket 02-16-2015 12:27 PM

Trade rumours about Kessel going to the Panthers:

Trade Talk: Kessel in the Sunshine State? - Article - TSN

Florida media is tweeting that Florida doesn't want to give up a "young stud" in exchange for Kessel. e.g. Huberdeau, Eckblad.

-getting some offense to support Lu?

Gilgamesh 02-16-2015 01:01 PM

No young stud for Kessel, what else would they give up? Draft picks? Their current roster outside of prospects would not suit the leafs' needs.

It's better to barely squeak into the playoffs than it is to barely miss them.

I agree, I'd like to see them utilize Matthias a little more!
